IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS CONSTITUTES YOUR AGREEMENT TO THE FOLLOWING TERMS AND CONDITIONS AS WELL AS THE TERMS OF USE, DMCA NOTICE, EXTERNAL LINKS POLICY AND PRIVACY POLICY SPECIFIED ON THE B3 METHOD INSTITUTE WEBSITE.
1. Acknowledgment and Agreement
The service provided through QUICKSTART TRAINING d/b/a B3 METHOD INSTITUTE Yoga (“B3 YOGA”) and the B3 Method Institute website (the "Service"), is owned and operated by The B3 Method Institute (which may also be referred to as “we” or “us”) and is provided to you ("you" or "Enrollee") in accordance with these Terms and Conditions.
The Terms of Use, External Links Policy, DMCA Notice and Privacy Policy are hereby incorporated into and made a part of these Terms and Conditions.
The B3 Method Institute may change any of these Terms and Conditions at any time by posting revised Terms and Conditions on The B3 Method Institute website. If The B3 Method Institute revises the Terms and Conditions, such revision shall be effective thirty (30) days after posting the new the Terms and Conditions on The B3 Method Institute website. You are responsible for periodically reviewing the Terms and Conditions, which you can do by clicking on the “the Terms and Conditions” link on The B3 Method Institute website. You agree that your continued use of the Service following any changes to the Terms and Conditions and after the changes take effect will constitute your acceptance of such changes. If you do not agree to such changes to the Agreement, your only remedy is to discontinue use of the Service and to cancel your account.
YOU HEREBY REPRESENT AND WARRANT TO THE B3 METHOD INSTITUTE THAT (A) YOU ARE 18 YEARS OF AGE OR OLDER, (B) YOU WILL PROVIDE TRUE, ACCURATE, CURRENT, AND COMPLETE INFORMATION (INCLUDING AN ACCURATE EMAIL ADDRESS OR ALTERNATE MEANS OF CONTACTING YOU) IN YOUR REGISTRATION FOR THE SERVICE, AND (C) THAT YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
2. Description of Service
The B³ Method Institute is an Educational Organization offering wellness courses, business courses, yoga classes and other self-development offerings.
3. Enrollment
Enrollment Policy. Class enrollments are accepted on a first pay, first serve basis. The B3 Method Institute cannot guarantee a seat until full payment has been received. Enrollees who have not paid in full will not be admitted to the class.
Trial Enrollment
A trial enrollment allows you to sample online classes and access certain materials for a period of days. You can start your trial enrollment by establishing an account and making a processing payment and/or entering the enrollment information. To cancel, simply cancel through The B3 Method Institute website or email The B3 Method Institute [email protected]. If you do not cancel your trial enrollment prior to the end of your trial period you may be charged the applicable subscription fee automatically to the credit card or to the checking account associated with the debit card you provided for your processing fee payment. If you select the Auto-Renewal payment option, on or about the same day of the month that your account was activated, our then-current monthly subscription fee will be automatically charged to the credit card you provided to us today or to the checking account associated with the debit card you provided for your processing fee payment.
4. Pricing/Payment Terms
The current prices for the subscription service and individual classes are specified on The B3 Method Institute website and may be updated by The B3 Method Institute from time to time. All payments must be made in advance.
5. Term of Subscription Services
The terms of subscription vary from product to product.
6. Termination/Cancellations/Holds
Please see section 12. B3 Yoga for specific B3 Yoga cancellation requirements.
Termination by The B3 Method Institute
You agree that if you fail to comply with The B3 Method Institute’s terms and conditions, rules, policies and/or Community Trust Agreements, The B3 Method Institute may unilaterally terminate your enrollment in a course and/or your subscription and/or your account and retain any payments you have made.
Class Cancellations by You
You have the right to cancel your enrollment in a live class anytime within the first three days after the date of purchase and receive a full refund. To cancel, simply login to your account on The B3 Method Institute website and follow the instructions or email The B3 Method Institute at [email protected]. The cancellation must be made prior to midnight (Eastern Standard Time) of the third calendar day after the date of purchase. PLEASE NOTE: The B3 Method Institute will not grant a refund or give you a credit if you have started the course or downloaded course materials.
You may cancel your enrollment in a live class without a cancellation fee up to 15 business days prior to the class start date and receive transferrable credit, which may be used towards a future class. To cancel, simply login to your account on The B3 Method Institute website and follow the instructions or email The B3 Method Institute at [email protected]. The cancellation must be made prior to midnight (Eastern Standard Time) of the 15th business day prior to the start date of the live class. You agree that if you cancel the class less than 15 business days prior to the class start date, then The B3 Method Institute will retain any processing or enrollment fees. The B3 Method Institute asks that you notify us as soon as possible if you need to cancel a class.
Subscription Cancellations by You
You have the right to cancel your subscription within the first three days after the date of purchase and receive a full refund. Thereafter, you may cancel your subscription service at any time and the cancellation will be effective at the end of the then-current subscription period. To cancel, simply login to your account on The B3 Method Institute website and follow the instructions or email The B3 Method Institute at [email protected].
Holds
A “hold” is a permitted suspension of your subscription service without penalty. You may request a hold by making a request via email to [email protected]. Holds are granted at The B3 Method Institute’s sole discretion for a period of up to ninety (90) days. Holds will only be granted for those with extenuating circumstances, such as military deployment or documented medical conditions.
7. Indemnification
You agree to indemnify, defend and hold The B3 Method Institute (as well as its managers, members, officers, directors, employees, agents, representatives, information providers and licensors) harmless against liability related to any claims, losses or expenses, including without limitation reasonable attorney's fees, arising from or in any way related to your use (or the use by any person using your computer or your account) of The B3 Method Institute website and/or your violation of The B3 Method Institute’s rules and policies or these Terms and Conditions. This indemnity obligation shall survive termination of The B3 Method Institute website
8. Disclaimer of Warranties and Liability
The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including, but not limited to warranties of merchantability or fitness for a particular purpose. The B3 Method Institute has not made and does not make any promise, express or implied, regarding any opportunities for or benefits to an enrollee resulting from the services. Neither these terms and conditions nor any documentation furnished under it is intended to express or imply any warranty that the service will be uninterrupted, timely, or error-free. The B3 Method Institute, its owners, managers, officers, employees, agents and assigns, shall not be liable, under any circumstances for any loss of business, profits, or goodwill, loss of use or data, interruption of business, or for any indirect, special, incidental, or consequential or exemplary damages of any character, even if the B3 Method Institute is aware of the risk of such damages, that result in any way from your use of or inability to use this service. Our liability to you shall not, for any reason, exceed the amount actually paid by you to the B3 Method Institute under this agreement. Some jurisdictions do not allow the exclusion of certain warranties or liabilities, so some of the above exclusions may not apply to you.
9. Disputes.
All users of The B3 Method Institute website and/or the Services agree that any and all disputes arising out of, in connection with or in any way related to these Terms and Conditions is Agreement, or the products or services associated with this Agreement, shall be fully and finally settled in binding arbitration proceedings under the then-current Commercial Rules of Arbitration of the American Arbitration Association (“Rules”) by one arbitrator appointed in accordance with the Rules. The award of the arbitrator shall be enforceable by any court of competent jurisdiction. The arbitration proceeding shall be construed in accordance with the applicable laws of the State of Ohio and all arbitration proceedings shall be held in Ohio. The non-prevailing party in any arbitration proceeding or other legal action shall reimburse the prevailing party for the prevailing party’s costs (including reasonable legal fees) incurred in such arbitration proceeding or legal action.
10. General
These Terms and Conditions and the relationship between the parties shall be governed by the laws of the state of Ohio without regard to its conflict of law provisions. The parties agree to submit to the personal and exclusive jurisdiction of the state or federal courts located in Warren County, Ohio. The B3 Method Institute’s failure to exercise or enforce any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and agree that the other provisions of these Terms and Conditions remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or to these Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in these Terms and Conditions are for convenience only and have no legal or contractual effect. You may not assign any or all of your rights and obligations under these Terms and Conditions without The B3 Method Institute’s prior written consent, which may be withheld in our sole discretion. You agree that all provisions in these Terms and Conditions relating to ownership of intellectual property, proprietary rights, warranty disclaimers, limitation of liability, and indemnification shall survive the termination of your agreement with The B3 Method Institute. The parties agree that agree that nothing in these Terms and Conditions shall be deemed to convey any third party rights or benefits. Neither party shall be liable to the other for any delay or failure in performance under these Terms and Conditions resulting directly or indirectly from acts of nature or causes beyond its reasonable control. These Terms and Conditions constitute the entire agreement between the parties with respect to the Service and supersede all previous proposals, both oral and written, representations, writings and all other communications between the parties.
11. Grant of Rights / Use of Images, Voice and/or Likeness
Student and/or responsible party hereby grant the B3 Method Institute the right to record Student’s voice, sounds, conversations, images and likeness in photographs, video, audiotape and/or other media (“Student Media”)
Student and/or responsible party hereby give their consent to the B3 Method Institute unrestricted reproduction, use and dissemination of Student Media for any purpose including, without limitation, virtual course streaming and recording, development, marketing, advertising, licensing, scale, distribution, and promotion of B3 Method Institute's classes workshops, teacher training, events, merchandise and brand.
Student and/or responsible party hereby waive any and all rights to such Student Media.
Student and/or responsible party hereby represent to the B3 Method Institute that student and/or responsible party have the right and authority to grant the rights set forth above, that student has no agreement or commitment that would limit or prohibit student from granting the rights to set forth above, that student and/or responsible party have voluntarily entered into the Grant of Rights.
12. B3 Yoga
Cancellation/Refund Policy
A B3 Yoga subscription student (“student”) may cancel her/his subscription agreement with B3 YOGA at any time by cancelling the subscription within the e-learning course platform or submitting an email request to [email protected] at least 3 business days prior to the monthly renewal date. Students have the right to cancel their enrollment in a live class anytime within the first three days after the date of purchase to receive a full refund. To cancel, simply login to your account on The B3 Method Institute e-learning platform and follow the instructions or email The B3 Method Institute at [email protected] within 3 days. The cancellation must be made prior to midnight (Eastern Standard Time) of the third calendar day after the date of purchase to receive the refund. PLEASE NOTE: The B3 Method Institute will not grant a refund or give you a credit if you have already accessed the online course curriculum, attended a live session, viewed the yoga library, and/or downloaded course materials.
By purchasing a membership/class and/or enrolling in a free trial of B3 Yoga on-demand or live classes, you understand that B3 YOGA cannot and will not evaluate your physical condition and is relying solely on the information you provide the instructor. Your purchase indicates that you are fully aware of the risks (including without limitation physical injury or death) involved with participation and that you knowingly assume such risks.
By purchasing a membership/class and/or enrolling in a free trial of B3 Yoga on-demand or live classes, you represent to B3 YOGA that within the past 6 months you have been examined by a licensed medical doctor and have been found by that doctor to be in good health, with no medical condition that would affect your ability to perform yoga exercises. You agree that B3 YOGA reserves the right to require participants to obtain a written statement from a licensed medical doctor that they are in good health with no medical condition that would affect an ability to perform yoga exercises.
By purchasing a membership/class and/or enrolling in a free trial of B3 Yoga on-demand or live classes, you understand B3 YOGA cannot and will not render any medical services including medical diagnosis of a participant’s physical condition.
By purchasing a membership/class and/or enrolling in a free trial of B3 Yoga on-demand or live classes, you represent to B3 YOGA that you have had an adequate opportunity to consult with legal, medical and other advisors and assume the risk of an injury, loss and/or other damages that you may sustain as a result of participating in B3 YOGA’s offerings.
By purchasing a membership/class and/or enrolling in a free trial of B3 Yoga on-demand or live classes, you acknowledge and agree that all class registration and subscription fees are non-refundable, non-transferable and cannot be extended.

By purchasing a membership/class and/or enrolling in a free trial of B3 Yoga on-demand or live classes, you represent to us that you understand and agree to the B3 Yoga Student Code of Conduct outlined below. You understand that if you do not agree or comply, B3 Yoga may elect to terminate your right to enter the virtual studio and/or participate in classes, workshops, and sessions.
I will arrive 5 minutes prior to the class start time.
I will enter and leave the virtual studio peacefully and mute my microphone.
I will come to practice with an empty stomach (unless a specific medical condition prevents me from doing this).
I will hydrate before and after class with at least 16-32 ounces of water.
I will wear comfortable exercise clothing.
If I have a health issue (illness, injury or medical condition), I will let my teacher know before class. I understand and acknowledge that not every pose is appropriate for every person.
I will let go of my competitive mind-set and any expectations I may have about my abilities. I will take breaks whenever I need to and I will come out of any posture if I feel any strain or pain. I understand that my body responds best when I honor it.
I will try to stay for the entire class. If I need to leave the meeting room early, I will do so muted and quietly.
